Terms of Sale
The rules for buying from BRND Collection, in plain English.

BRND Collection is an online store operated by BRND Scale LLC, 2 Stysly Ln, Spring Valley, NY 10977 ("we", "us", "our"). These Terms of Sale apply to every order you place on this website. By placing an order, you agree to them.
1. Orders and acceptance
When you place an order, you are offering to buy the items in your bag. The confirmation email we send means we received your order; it does not mean we have accepted it. We accept your order when we ship it.
We may refuse or cancel any order, or limit quantities, for example if an item is out of stock, a price or description is wrong, we can't verify your payment or address, or we suspect fraud or resale. If we cancel an order you already paid for, we will refund you in full.
2. Prices and pricing errors
All prices are in US dollars. Sales tax and shipping are calculated and shown at checkout before you pay. Prices and availability can change at any time without notice.
We work hard to keep prices and product details accurate, but mistakes can happen. If an item is listed at the wrong price, we may cancel the order and refund you, or contact you with the correct price and let you choose whether to continue. We are not required to sell an item at a price that is clearly an error.
3. Payment
Payments are processed securely by Stripe. We do not see or store your full card number. Your payment is charged when you place your order.
4. Shipping and delivery
We currently ship within the continental United States only. Fragrance ships by ground only. Delivery dates shown are estimates, not guarantees. Title and risk of loss pass to you when we hand your order to the carrier. See our Shipping Policy for details.
5. Returns
Unopened items can be returned within 30 days. Opened items are never accepted. The customer pays return shipping, unless the return is due to our error (wrong, damaged or defective item), in which case we cover the return shipping. See our Returns Policy for how it works.
6. Product information
Product photos are for illustration. Packaging, box designs and colors can differ from the photos, and manufacturers sometimes change packaging without notice. Brand names and trademarks belong to their owners. Unless we say otherwise, we are not affiliated with or endorsed by the brands we sell.
7. Fragrance allergy and safe-use disclaimer
Fragrances contain alcohol, essential oils and other ingredients that can cause skin irritation or allergic reactions in some people. Before buying, please check the ingredient list on the product packaging or the brand's website, especially if you have sensitive skin or known allergies.
- Test a small amount on your skin first, and stop using the product if irritation occurs. Ask a doctor if a reaction continues.
- For external use only. Do not swallow. Avoid contact with eyes.
- Fragrance is flammable. Keep it away from heat, sparks and open flame.
- Keep out of reach of children and pets.
We are not responsible for reactions caused by a product's ingredients. Because opened items can't be returned, an allergic reaction does not make an opened item returnable.
8. Disclaimer of warranties
Products are covered only by any warranty their manufacturer provides. Apart from that, and to the fullest extent the law allows, products and this website are provided "as is" without other warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your purchase or use of our products or this website. Our total liability for any claim related to an order is limited to the amount you paid for the product that gave rise to the claim. Some states do not allow these limits, so they may not all apply to you. Nothing in these terms limits any rights you have that cannot be limited by law.
10. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in the State of New York, and you agree to their jurisdiction.
11. Changes to these terms
We may update these terms from time to time. The version posted when you place your order applies to that order. The date at the top of this page shows when they last changed.
